Terms of use — tarifa.life

1. Acceptance

By accessing tarifa.life (hereinafter "the Platform"), you accept these Terms of Use (hereinafter the "Terms") without reservation. If you do not agree with these terms, you must stop using the Platform.

These Terms may be amended at any time. The applicable version is the one in force at the time of your connection.

2. Description of the service

tarifa.life is a platform that offers:

A directory of kite/wing/foil spots and schools in Tarifa
A directory of restaurants, bars, clubs and accommodation in Tarifa
A system of ephemeral stories (photos/videos visible for 24h)
A second-hand marketplace between individuals
For partner venues with a subscription: table ordering via QR code, takeaway ordering, waitlist, dashboard
A messaging system between users
A chatbot assistant based on artificial intelligence (Claude, provided by Anthropic)

3. User account

To use certain features, you must create an account (email + password, or via Google). You undertake to provide accurate information and to keep your credentials confidential. Any activity carried out from your account is deemed to have been performed by you.

The publisher reserves the right to suspend or delete any account in the event of a breach of these Terms, without notice or compensation.

4. Rules of conduct

When using the Platform, you must not:

Publish illegal, hateful, violent, defamatory or pornographic content
Harass, threaten or impersonate another user
Publish false or misleading information, or spam
Collect or harvest the personal data of other users
Circumvent security measures or attempt to access non-public areas
Use the Platform for unauthorised commercial purposes (scraping, resale of data)
Publish copyright-protected content without authorisation

Any breach of these rules may result in the removal of the content, the suspension of the account and, where applicable, a report to the competent authorities.

5. Content published by users

By publishing content (story, review, message, photo, video, marketplace listing), you declare that you are its author or that you hold the necessary rights. You accept that this content may be visible to other users and indexed by search engines.

You grant tarifa.life a non-exclusive, free, worldwide licence, valid for the entire term of legal protection, to host, display, adapt and distribute this content as part of the operation of the Platform.

tarifa.life is not the author of this content and acts as a host within the meaning of Directive 2000/31/EC and Spanish Law 34/2002 (LSSI-CE). You may report any unlawful content to info@tarifa.life; we will remove it promptly after verification.

6. AI assistant (chatbot)

The Platform includes a conversational assistant based on artificial intelligence models provided by Anthropic PBC (Claude). This assistant may make mistakes and provide inaccurate or incomplete information.

No response from the AI assistant constitutes a contractual commitment or legal, medical, financial or professional advice. The information provided is indicative. For critical questions (payment, refund, security), the assistant automatically forwards the request to a human.

Your exchanges with the assistant are saved on our servers to ensure the continuity of the conversation and to improve the service. See our Privacy Policy for more details.

7. Venues and marketplace: intermediary role

tarifa.life acts solely as a technical intermediary between users and:

the schools, restaurants, bars, accommodation and other listed venues;
the individuals who sell or buy on the marketplace;
users with one another in the messaging system.

The transactions, services and content are provided directly by these third parties. tarifa.life is not a party to the contracts concluded between users, nor between users and venues. Consequently, tarifa.life cannot be held liable for:

the quality, conformity, freshness or safety of the dishes ordered;
the quality or safety of the lessons given by the schools;
the condition, authenticity or availability of the goods sold on the marketplace;
disputes between users and venues, or between users themselves;
a venue's failure to comply with its contractual, legal or regulatory obligations;
weather conditions, the state of the spots, crowding, or the quality of the wind and sea;
any physical injury occurring during the practice of sporting activities (kite, wing, surf, etc.).

8. Limitation of liability

The Platform is provided "as is" and "as available". tarifa.life does not guarantee:

uninterrupted or error-free availability of the service;
compatibility with all devices, browsers or operating systems;
the accuracy, completeness or timeliness of the information displayed;
the complete absence of viruses, bugs or occasional unavailability.

To the extent permitted by applicable law, tarifa.life's liability is limited to the amount actually paid by the user over the last 12 months (or zero for free users). This limitation does not apply in the event of gross or wilful misconduct, bodily harm, or for any liability that cannot legally be limited under applicable law.

Under no circumstances can tarifa.life be held liable for indirect damage, loss of turnover, loss of data, loss of opportunity, damage to reputation, or the consequences of a misuse of the Platform.

9. Links to third-party sites

The Platform may contain links to third-party sites (venues' social networks, Google Maps, etc.). tarifa.life is not responsible for the content, terms or practices of these third-party sites. You access them at your own sole responsibility.

10. Suspension and termination

You may delete your account at any time by writing to info@tarifa.life. Deletion results in the loss of your published content (except for content needed for the continuity of the service or for legal evidence, retained in accordance with our Privacy Policy).

tarifa.life may suspend or terminate your access at any time and without notice, in the event of a breach of these Terms, abusive behaviour, or for technical, legal or security reasons.

11. Amendment of the Terms

tarifa.life may amend these Terms at any time. The date of the last update is indicated at the top of the document. Any use after the update constitutes acceptance.

12. Governing law and jurisdiction

These Terms are governed by Spanish law. In the event of a dispute, and after an attempt at amicable resolution, the competent courts of Cádiz (Spain) shall have sole jurisdiction, subject to the mandatory provisions applicable to consumers residing in the European Union (who may bring proceedings before the courts of their place of residence).

In accordance with EU Regulation 524/2013, consumers have access to the European online dispute resolution platform: ec.europa.eu/consumers/odr.
